TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using Gutterspace ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Accounts

You must be at least 13 years old to create an account. You are responsible for maintaining the security of your account and all activity that occurs under it. You must provide accurate information when creating your account.

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

3. Creator Terms

As a creator on Gutterspace, you agree that:

  • You own or have the rights to all content you upload
  • Your content does not infringe on any third-party rights
  • You will not upload illegal, harmful, or fraudulent content
  • Gutterspace collects a 7% platform fee on all sales
  • Stripe processing fees are deducted separately from your earnings
  • Payouts are processed weekly, subject to Stripe's minimum payout thresholds

4. Purchases & Payments

All purchases are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. Digital comic purchases are generally non-refundable (see our Refund Policy for exceptions).

5. Intellectual Property

Creators retain full ownership of their content. By uploading content to Gutterspace, you grant us a limited, non-exclusive license to display and distribute your content on the Platform for the purpose of operating the service.

The Gutterspace name, logo, and platform design are our intellectual property. You may not use our branding without written permission.

6. Prohibited Content

You may not upload or share content that:

  • Infringes on copyrights, trademarks, or other intellectual property
  • Contains illegal material
  • Promotes violence or discrimination
  • Contains malware or malicious code
  • Is fraudulent, deceptive, or misleading

7. Termination

We may suspend or terminate your account for violations of these terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Platform ceases, but provisions that by their nature should survive (such as payment obligations) will remain in effect.

8. Disclaimers

The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. We are not responsible for user-generated content on the Platform.

9. Limitation of Liability

To the maximum extent permitted by law, Gutterspace shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after changes constitutes acceptance.
