DMCA POLICY

Gutterspace respects the intellectual property rights of creators and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid takedown requests.
Filing a Takedown Notice
If you believe your copyrighted work has been uploaded to Gutterspace without authorization, you may submit a DMCA takedown notice. Your notice must include:
- Identification of the copyrighted work you claim has been infringed
- Identification of the material on Gutterspace that you claim is infringing, with enough detail for us to locate it (e.g., URL)
- Your contact information (name, address, phone number, email)
- A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notice is accurate and you are the copyright owner or authorized to act on their behalf
- Your physical or electronic signature

What Happens After a Takedown
Upon receiving a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material and notify the user who posted it. The user's account may be flagged.
Counter-Notice
If you believe your content was removed by mistake or misidentification, you may submit a counter-notice containing:
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, phone number, and a statement consenting to the jurisdiction of the federal court in your district
- Your physical or electronic signature
After receiving a valid counter-notice, we will forward it to the original complainant. If they do not file a court action within 10–14 business days, we may restore the removed material.
Repeat Infringer Policy
Gutterspace maintains a strict repeat infringer policy. Users who receive multiple valid DMCA takedown notices will have their accounts terminated. We track all takedown notices and may terminate an account after as few as two confirmed strikes, at our discretion.
Good Faith Warning
Filing a false DMCA takedown notice is a serious matter. Under the DMCA, you may be liable for damages (including costs and attorney's fees) if you knowingly misrepresent that material is infringing. Please ensure your claim is legitimate before filing.
